Fourth Wall Restaurants, LLC, Quality Meats Restaurant, and Michael Stillman – Alleged Wage & Hour Violations

On September 20, 2011, Joseph & Kirschenbaum LLP filed a class and collective action complaint against Fourth Wall Restaurants, LLC, Quality Meats Restaurant, and Michael Stillman. The lawsuit seeks to recover misappropriated tips, minimum wages, overtime compensation, and spread-of-hours pay for hourly food service workers.

Plaintiffs allege that Defendants required the service staff to share tips with tip-ineligible employees. They assert that Quality Meats used workers’ hard-earned tips to supplement the wages of non-service employees, rather than properly paying them. In addition, Plaintiffs allege that Defendants unlawfully applied the tip credit allowance, thereby impermissibly paying employees less than the full minimum wage, as well as denied them proper overtime and spread-of-hours pay. The parties in this case are currently engaged in discovery.

Quality Meats is part of the multi-restaurant empire built by Michael and Alan Stillman, with whom our firm is currently involved in a similar lawsuit on behalf of employees of sister establishment Park Avenue Café for alleged noncompliance with the Fair Labor Standards Act (FLSA) and the New York Labor Law (NYLL).
