Legal Battle on Tap for Heartland Brewery

This article from New York Magazine (March 7, 2007) covers the brewing brouhaha between Joseph, Herzfeld, Hester & Kirschenbaum LLP's own Maimon Kirschenbaum and the Heartland Brewery Company. At issue is Heartland's allegedly heartless treatment of waitstaff, which include wage and hour violation charges galore. Founder Jon Bloostein shot back against the accusations, which included:

  • waiters forced to pool tips illegally
  • systemic abuse of punch card recording (time shaved off illegally)
  • company failed to pay overtime to some workers

According to the article, our firm had successfully pursued a similar case against steak giant Smith & Wollensky in 2006.
